GENERAL TERMS AND CONDITIONS OF THE HMA ACADEMY

1. Contractual parties

The General Terms and Conditions of the HMA Academy govern the contractual relationship with participants (hereinafter “Customers”) for open seminars, in-house training courses and online training courses offered by the course provider (hereinafter “HMA Academy”).

HMA Academy is a brand of Hopmann Marketing Analytics GmbH. All HMA Academy training courses are conducted independently by Hopmann Marketing Analytics GmbH.

2. Services of the HMA Academy

HMA Academy provides its services in accordance with the current seminar descriptions on the website www.marketinganalytics.de/academy. The terms seminar(s), training(s), course(s) or workshop(s) are used as synonyms below.

The prices listed on the website www.marketinganalytics.de/academy are exclusive of VAT and are per person.

In addition to the training, the face-to-face events in Munich and at Schliersee include cold and hot drinks, snacks and lunch (incl. 1 drink) per seminar day, unless otherwise stated. The price also includes a handout for the seminar and a certificate for successful participation.

The HMA Academy retains all rights to the seminar documents. The passing on or distribution of training materials is not permitted.

3. Registration and confirmation through the HMA Academy

Registrations for seminars are made in writing using the form on the respective training-specific website www.marketinganalytics.de/academy, via the contact form on www.marketinganalytics.de/kontakt, by email to academy@marketinganalytics.de or your personal contact at Hopmann Marketing Analytics GmbH.

All registrations will be considered in the order in which they are received – until the maximum number of participants specified on the website www.marketinganalytics.de/academy is reached.

The HMA Academy will confirm receipt of your registration in writing and inform you whether you have been allocated one of the free places.

4. Withdrawal, rebooking and representation by the customer

4.1 Withdrawal

You have the option of withdrawing from the contract for your booked training course. The following processing fees will be charged:

  • Up to 30 calendar days before the start of the seminar: 10% of the course fee (plus VAT)
  • Up to 7 days before the start of the seminar: 50% of the course fee (plus VAT)
  • Up to 1 day before the start of the seminar: 75% of the course fee (plus VAT)
  • From the 1st day of the seminar: 95% of the course fee (plus VAT)

4.2 Rebooking

It is possible to rebook your booked training course once per person to another date or another course. The following processing fees will be charged:

  • Up to 30 calendar days before the start of the seminar: free of charge
  • Up to 7 days before the start of the seminar: 15% of the course fee (plus VAT)
  • Up to 1 day before the start of the seminar: 25% of the course fee (plus VAT)
  • From the 1st day of the seminar: 50% of the course fee (plus VAT)

4.3 Representation

If you are unable to attend the training yourself, you can nominate a representative. This is possible free of charge until the start of the first day of the seminar. Please let us know via academy@marketinganalytics.de and name the representative.

5. Cancellation, rebooking or substitution by the HMA Academy

The HMA Academy reserves the right to cancel seminars due to insufficient demand or number of participants. As a rule, seminars are only held with a minimum of 3 participants. In addition, the HMA Academy reserves the right to cancel training courses for other important reasons for which we are not responsible (e.g. sudden illness of the trainer, sudden failure of the training room, force majeure).

In the event of such cancellations, any participation fees already paid will be refunded in full. Further liability and compensation claims arising from the cancellation or change of the seminar and not relating to injury to life, limb or health are excluded, unless there is intent or gross negligence on our part. Please also note this for hotel rooms booked by you as well as flight or train tickets. HMA Academy cannot be held liable for compensation for travel or accommodation costs or other consequential damages.

In the event that the training is canceled by the HMA Academy, we are obliged to offer the customer an alternative date. If no agreement is reached on an alternative date, the Customer is free to withdraw from the contract. In this case, HMA Academy shall not be entitled to cancellation or rebooking fees.

If a seminar is canceled by the HMA Academy, all participants will be informed of this in good time – in the event of the sudden cancellation of the trainer or the training premises, at the latest on the morning of the start of the seminar.

The HMA Academy is entitled to replace the originally announced trainers in the event of spontaneous absence (e.g. due to illness or accident) with an adequate substitute if available.

6. Terms of payment and discounts

The participation fees plus VAT are listed on the website www.marketinganalytics.de/academy. They are generally due without deduction on the first day of the seminar and are payable within 14 days. You will receive a separate invoice from Hopmann Marketing Analytics GmbH to the e-mail address you provided when booking.

If you have booked the training with a discount offer, the corresponding discount will be deducted from your invoice. Multiple discounts cannot be combined.

7. Liability and data protection

7.1 The liability of the HMA Academy is governed by the statutory provisions and is otherwise limited. The training content and seminar documents are prepared to the best of our knowledge and research. However, the HMA Academy is not liable for the topicality, quality, correctness and completeness of the content.

8. Photo and video recordings

Photographs and videos may be taken during the training sessions. This includes, for example, recordings of the participants and trainers or of the training documents produced jointly during the seminars.

If you do not consent to these recordings, please contact your trainer before the start of the training.

The use of photo and video recordings for advertising purposes is only permitted with the prior consent of the customer.

9. Place of jurisdiction and applicable law

The place of performance and jurisdiction for all disputes arising from the contractual relationship is the registered office of Hopmann Marketing Analytics GmbH with the HMA Academy brand (Munich, Germany). German law shall apply. Should any provision of the contract be or become invalid or unenforceable in whole or in part, this shall not affect the remainder of the contract.

Amendments or additions to these General Terms & Conditions must be made in writing.
